Purpose

Operacy LLC is committed to resolving disputes fairly, efficiently and transparently. This policy outlines the process for addressing conflicts related to our recruitment services.

Scope

This policy applies to disputes involving Operacy LLC, clients, candidates, contractors and other stakeholders.

Fairness: Disputes will be resolved impartially.

Timeliness: Disputes will be addressed promptly.

Transparency: The dispute resolution process will be transparent.

Confidentiality: Disputes will be handled confidentially.

Dispute Resolution Process

Step 1: Initial Review

The dispute is reported to the Managing Director, who will review the issue.

Step 2: Informal Resolution

The Managing Director will attempt to resolve the dispute through mediation or negotiation.

Step 3: Formal Investigation

If informal resolution fails, the Managing Director will conduct a formal investigation.

Step 4: Resolution

The Managing Director will make a decision and communicate it to the parties.

Step 5: Appeal

Parties may appeal to an independent mediator or arbitrator.

Dispute Resolution Methods

Mediation: Neutral third-party mediation.

Arbitration: Neutral third-party arbitration.

Negotiation: Direct communication.

Timeframes

Initial Review: 3-5 business days

Informal Resolution: 5-10 business days

Formal Investigation: 10-20 business days

Record Keeping

Operacy LLC will maintain accurate records of disputes.

Training and Education

The Managing Director will participate in regular training and education on dispute resolution.

Review and Revision

This policy will be reviewed and revised annually.

This policy complies with:

District of Columbia Human Rights Act

Title VII of the Civil Rights Act of 1964

Americans with Disabilities Act (ADA)

Age Discrimination in Employment Act (ADEA)

Governing Law and Jurisdiction

Disputes will be governed by District of Columbia laws. Parties agree to submit to the exclusive jurisdiction of District of Columbia courts.

Venue

Legal actions will be brought exclusively in the Superior Court or United States District Court for the District of Columbia.

Waiver of Jury Trial

Parties waive their right to a jury trial.

Arbitration

Disputes may be resolved through binding arbitration with the American Arbitration Association.

Effective Date
